Worker’s Compensation for Healthcare Workers During COVID-19
The Michigan Worker’s Disability Compensation Act is meant to be a safety net for workers who are injured or become ill on the job. People working in the healthcare industry today are quite vulnerable. They could become seriously ill due to workplace exposure to COVID-19. Governor Whitmer has signed into effect special rules that will apply to healthcare workers during this pandemic. You can find a link to the rules here.
The rules create a presumption that any healthcare worker diagnosed with COVID-19, and who makes a worker’s compensation claim for it, is presumed to have been exposed at work. In other words, if you are a healthcare worker and you contract COVID-19, you should be able to successfully claim worker’s compensation. There are penalties that will apply if any employer denies such a claim without specific facts to prove you were exposed outside of work.
Of course, like all laws, there will people who attempt to violate it. Undoubtedly, employers and insurance carriers will try to find excuses to deny expensive COVID-related claims.
